Question about Outlook Express

Dear Sir/Madam,

Under instructions from client, Dr. Rashmi Vora, Indian Inhabitant,  Orthopedic surgeon by profession and having clinic at Navdeep Clinic, Navdeep, Ashram Road, Ahmedabad  - 380014, (“Dr. Vora”),  I have to address you as follows:

1. Dr. Vora having tremendous faith and trust in the services and security offered by your prestigious organization, had created various email accounts with you viz. *** Email address is removed for privacy ***, *** Email address is removed for privacy ***, *** Email address is removed for privacy ***, *** Email address is removed for privacy ***. Dr. Vora predominantly uses *** Email address is removed for privacy *** for professional/business purposes, *** Email address is removed for privacy *** for personal (family) and *** Email address is removed for privacy *** and *** Email address is removed for privacy *** for personal (friends) purposes. It may be noted that the each such email address is mentioned in the address book or is provided as an alternate contact email address in the other abovementioned email accounts.
2. Dr. Vora has at all times maintained confidentiality of the password and other information in relation to the all the aforesaid email accounts and taken due care to ensure that no such information is provided to third parties, and changed his password on a regular basis.
3. The email address *** Email address is removed for privacy *** was created with you, by Dr. Vora, over a decade ago, and Dr. Vora used the same on a regular basis upto 26^th May, 2013 for dealing in his matters with respect to inter alia, banking and investments (the “Email ID”).
4. Unfortunately, on 27^th May, 2013, much to the shock and surprise of Dr. Vora, he discovered through his professional / business connections, friends, relatives and other acquaintances, of the possibility of the Email ID being used by an unauthorized user, as an email from the Email ID was sent out to email addresses stored on the Email ID, seeking Euro 2,500/- from such addressees to aid the alleged surgery of Dr. Vora’s alleged niece, Nadira.
5. It appears that the aforesaid unauthorized usage of the Email ID has taken place pursuant to Dr. Vora having provided certain information via email from the Email ID, on about 24^th May, 2013 in respect of the Email ID, to a person purporting to be you and having requested such information. Dr. Vora, believing the request for such information by you, due to change of mobile handset on which the Email ID was set up then by Dr. Vora, bonafide, provided the information in relation to the Email ID to such person. In the event, the above incident has led to unauthorized use of the Email ID, it would be extremely disappointing to learn that a prestigious organization as yours, failed to filter such phishing email purporting to have been sent by you.
6. It may be noted that Dr. Vora has not sent any such email to any of such addressees, nor has authorized any person to send such email using the Email ID. Further, neither does Dr. Vora have any niece by the name of Nadira, nor was Dr. Vora in the need of any sums, nor has requested any person through any means whatsoever for such sums from third parties. It may be noted that Dr. Vora is a leading doctor in his profession and has a thriving practice, an unblemished image and an enviable standing in the society. Dr. Vora further states and confirms that the contents of the said email in its entirety are absolutely false and untrue.
7. Fearing further unauthorized use of the Email ID, Dr. Vora took the following steps:
   1. Dr. Vora, immediately tried to access the Email ID, but was unable to sign in and discovered that the password to the Email ID had been changed without authorization of Dr. Vora. Hence, it was safe to assume that the Email ID had been hacked. Dr. Vora, then took the steps to change the password to the Email ID, however, the alternate email addresses and the phone number provided to you by Dr. Vora had also been changed.
   2. Upon failing to retrieve the password to the Email ID, Dr. Vora, immediately approached the local police station and provided details in relation to such unauthorized use of the Email ID. The police officers in charge then, upon investigation, were able to ascertain that such unauthorized use of the Email ID was conducted from the United States of America.
   3. Dr. Vora also had to go through the trouble of blocking approximately 20 (Twenty) credit cards, in his name, each having an approximate limit of Rs. 10,00,000/- (Rupees Ten Lakhs Only), and had the contact email address, being the Email ID, provided to the relevant banks, changed immediately.
   4. Dr. Vora then filled account verification forms sent by you to Dr. Vora on his other email address *** Email address is removed for privacy ***, on 28^th May, 2013, 29^th May, 2013 and 30^th May, 2013 and provided as much information in relation to the Email ID that he could re-collect. Dr. Vora provided information in relation to the Email ID as regards inter alia : (i) subjects of last emails sent; (ii) addressees of last emails sent; (iii) previously used passwords; (iv) internal folders created. Such information was then readily available to Dr. Vora as the Email ID was set up on his mobile instrument which had the required records in respect of the Email ID stored on such instrument. However, Dr. Vora was unable to provide answers to questions such as pet’s name etc. solely due to the inability to recollect the same as such information was provided at the time of the creation of the Email ID which was over a decade ago.
8. However, pursuant to having duly filled such account verification form on and having submitted the same to you on repeated occasions, you have in your last email replied back stating that you were unable to grant access to Dr. Vora to the Email ID due to the inability to verify Dr. Vora’s ownership of the Email ID pursuant to information having been provided to you.
9. It may be noted that Dr. Vora does not have access to the Email ID, nor to any emails received on the Email ID post 26^th May, 2013, nor to any of the emails sent and received on the Email ID prior to 26^th May, 2013, in relation to his professional/business aspects, due to which he has suffered losses in his profession/business, as the Email ID was used for professional purposes. Further, as he was receiving his bank account statements on the Email ID, Dr. Vora was put through great difficulty due to inability to access the Email ID and retrieve copies of such statements, in turn leading to failure to file his income tax returns with the Income Tax Department on time. It may be noted that Dr. Vora will not continue to receive any emails sent to the Email ID leading to significant further losses, damages, costs etc. Dr. Vora is presently forced to use his other email addresses for his business/profession related correspondence which transition will be a time consuming, troublesome and painstaking affair. Such aforesaid email purported to be sent by Dr. Vora seeking funds for and on behalf of Dr. Vora from the Email ID, is an attempt to damage Dr. Vora’s reputation in the society and amongst his professional/business connections.
10. In light of the above, it is evident that Dr. Vora has in respect to the Email ID, already gone through significant trouble, stress, trauma and harassment, due to the unauthorized use and hacking of the Email ID.
11. It may be noted that Dr. Vora is the rightful, full and complete owner of the Email ID and all the contents of the Email ID and such Email ID contains significant amount of private, confidential, and / or personal information including Dr. Vora’s credit card information, bank statements, investments etc. which is the sole, complete, full and absolute property of Dr. Vora and has full, complete and absolute rights, titles and interests in the same. Failure to retrieve such information / records and the possibility of any unauthorized use of the same could lead to irreparable harm, damage and losses to Dr. Vora.
12. We request you to assist us in regaining access to the Email ID and retrieve the emails, files and other information in the inbox, sent, other folders etc. of the Email ID.
